A California district lawyer declined to file costs Tuesday in opposition to former heavyweight boxing champion Mike Tyson after he was recorded on video in a bodily altercation with another passenger on a JetBlue flight.
San Mateo County District Attorney Steve Wagstaffe made the choice after having reviewed police stories and videos of the April 20 incident. Both the passenger, who has not been recognized, and Tyson requested that no charges be filed.
"Yesterday afternoon the San Mateo County District Attorney’s Office concluded its assessment of the case involving Mike Tyson at the San Francisco Airport on April 20, 2022 and the allegation that he dedicated a misdemeanor battery towards one other passenger on an airplane whereas ready on the terminal previous to departure," Wagstaffe said in a statement.
"Our determination is that we will not file any charges towards Mr. Tyson based mostly on the circumstances surrounding the confrontation. These include the conduct of the sufferer leading up to the incident, the interplay between Mr. Tyson and the sufferer, in addition to the requests of each the victim and Mr. Tyson that no expenses be filed on this case," Wagstaffe stated.
The case is now closed.
Cellphone video confirmed Tyson, 55, appearing to attempt to punch somebody who was pushing him away. Representatives for Tyson mentioned the person was harassing Tyson. The video did not show what happened before the altercation.
David Chesnoff, Richard Schonfeld and Martin Sabelli, attorneys for Tyson, responded to the choice to not file costs by thanking Wagstaffe, the San Mateo County sheriff and law enforcement agencies "for his or her cautious, diligent, and professional work."
